Terms of Service

1. Acceptance of Terms

By creating an account, placing an order, or using services provided by Arcus Host ("Provider", "we", "us"), you ("User", "Customer") agree to be bound by these Terms of Service (ToS), our Privacy Policy, and our Acceptable Use Policy. If you do not agree, you must not use our services.

2. Service Provision & Reseller Disclosure

• Nature of Services: We provide Virtual Private Servers (VPS), game server hosting (including but not limited to Minecraft), and associated web services.
• Reseller Status: You acknowledge we may act as an authorized reseller of infrastructure provided by third-party data centers (“Upstream Providers”).
• Upstream Dependency: Availability and any SLA commitments may depend on our Upstream Providers. We’re not liable for upstream outages, but we’ll act as liaison to help resolve issues.
• Support Scope: Services are “Self-Managed” unless stated otherwise.

3. Acceptable Use Policy (AUP)

Strict adherence is required. Violations may result in immediate suspension or termination without refund.

3.1 Prohibited Content & Activities

• Illegal Activity: Hosting CSAM, terrorism propaganda, phishing, or malware is prohibited and may be reported.
• Network Abuse: DDoS, port scanning, IP spoofing, and unsolicited email (SPAM) are banned.
• Cryptocurrency: Mining (e.g., Bitcoin/Monero/Chia) is prohibited on all plans.

3.2 Game Server Restrictions

• EULA Compliance: You must comply with relevant game EULAs (e.g., Mojang Minecraft EULA).

3.3 Resource Usage (Fair Use)

For shared services, users may not monopolize system resources. We reserve the right to throttle or reboot services sustaining 100% CPU usage for extended periods that degrade performance for others.

4. Accountability & Security

• Account Security: You’re responsible for keeping login credentials confidential.
• Responsibility: You’re responsible for all activity under your account, including access granted to others.
• Backups: You are responsible for off-site backups. We are not liable for data loss.

5. Payments, Refunds & Cancellation

• Billing: Services are billed in advance. Invoices are generated 4 days before due date.
• Billing Credits: Credits are non-refundable and only usable within our platform. Credit transfers require a ticket from the original user.
• Suspension: Unpaid invoices are suspended after due date. Data is not saved.
• Refunds: 1-day refund policy for new services (issued as dashboard credits only). dedicated servers, domains, and licenses are excluded.
• Chargebacks: Chargebacks may result in immediate termination and a permanent ban.

6. Intellectual Property

• User Content: We claim no ownership over your modpacks, world files, or configurations.
• License: You grant us a limited license to store/copy your content solely to provide the service.
• DMCA: We comply with applicable copyright procedures. Valid notices will be processed.

7. Limitation of Liability

• Indirect Damages: We are not liable for indirect/incidental/consequential damages to the maximum extent permitted by law.
• Liability Cap: Our total liability will not exceed the amount you paid for the service during the one (1) month prior to the claim.

8. Changes to Terms

We may modify these terms at any time. We will notify users of major changes via email or dashboard announcement. Continued use constitutes acceptance of updated terms.
